Meta Is Training AI on Your Photos — And You Can't Opt Out in the US

Every public photo you have ever posted on Facebook or Instagram is being used to train Meta's artificial intelligence models. Every public comment, every caption, every status update. Meta confirmed this in its updated privacy policy and has been doing it since at least 2023. European users can file an objection and opt out. American users cannot. There is no form, no setting, no button. If you live in the US, your content is training data and Meta has decided you do not get a say.

What Meta Is Collecting for AI Training

Meta's privacy policy, updated in September 2023 and further revised in 2024, explicitly describes the company's use of user content to train generative AI. The relevant section states that Meta collects and uses "information that's publicly available online or licensed" as well as "information from people's interactions with Meta Products" for AI development.

In practice, this means Meta trains its AI models — including Meta AI (the company's conversational assistant), Llama (its open-source large language model), and various image generation systems — on the following types of user data:

  • Public photos posted to Facebook or Instagram, including all metadata (location, timestamp, camera information, tagged individuals)
  • Public posts and captions — text content shared on public profiles, public pages, and public groups
  • Public comments on any public post, page, or group — even if your own profile is private
  • Public Stories and Reels that were viewable by anyone at any point
  • Profile information on public profiles — bio text, profile photos, cover photos, listed employers, schools, locations
  • Interactions with Meta AI — conversations with the AI assistant in Messenger, Instagram DMs, or WhatsApp

Meta has stated that it does not use the content of private messages between users, and it does not use content posted only to friends (non-public audience settings) for AI training. However, the distinction between "public" and "private" on Meta's platforms is more nuanced than most users realize.

What Counts as "Public" to Meta

  • Any post with audience set to "Public" — even if posted years ago
  • Any comment on a public Page, public Group, or public post
  • Profile photos and cover photos (always public on Facebook)
  • Any Instagram post on a non-private account
  • Stories and Reels that were shared publicly at any point (even if expired)
  • Information on public profiles: bio, employer, school, city

The EU vs. US Divide

The difference in how Meta treats European and American users on AI training is stark and instructive. It demonstrates exactly what happens when privacy law exists versus when it does not.

European Union: The Right to Object

In June 2024, Meta announced plans to begin training AI on EU user data under the "legitimate interests" legal basis provided by GDPR Article 6(1)(f). The backlash was immediate. NOYB (the Austrian privacy organization founded by Max Schrems) filed complaints with multiple European data protection authorities. The Irish Data Protection Commission — Meta's lead EU regulator — contacted Meta, and the company paused its EU AI training plans before they went live.

In late 2024, Meta resumed with a modified approach. EU and UK users received notifications explaining that Meta planned to use their public content for AI training. The notification included a link to an objection form — a mechanism required by GDPR Article 21, which gives individuals the right to object to processing based on legitimate interests. Users who submitted the form had their content excluded from AI training datasets.

The process was not perfect. Privacy advocates criticized it as being deliberately inconvenient — the form was several steps deep, required a written explanation, and Meta reserved the right to reject objections. But the mechanism existed because EU law required it.

United States: Nothing

US users received no notification, no objection form, and no mechanism to prevent their content from being used for AI training. Meta did not pause AI training for US users at any point. The company's position is straightforward: US law does not grant users the right to object to data processing for AI training, so Meta does not offer one.

This is technically correct. The United States has no comprehensive federal privacy law. The CCPA gives California residents the right to opt out of the sale of personal information and the sharing of personal information for targeted advertising, but Meta's AI training does not clearly fall into either category. Meta is not selling user photos to third parties — it is using them internally to build its own AI products. And training AI models is not "cross-context behavioral advertising" as defined by the CPRA.

The result is a two-tier privacy system. If you live in Paris, you can object to Meta training AI on your vacation photos. If you live in Philadelphia, the same photos are training data with no recourse.

Meta AI and Cloud Processing: Your Private Photos

In late 2025, Meta rolled out a feature called "cloud processing" for Meta AI, initially available in the US and Canada. This feature enables Meta AI to access information stored on your device — including photos in your camera roll — to provide contextual responses. For example, you could ask Meta AI to "find the photo I took at the restaurant last week" or "summarize my recent photos."

Cloud processing is opt-in. Users must explicitly enable it, and Meta has stated that the feature processes data in a "privacy-protected" environment. However, privacy researchers have raised several concerns:

  • Scope of access: Once enabled, Meta AI can analyze photos that were never posted publicly — images from your camera roll that you chose not to share on social media.
  • Processing environment: Despite Meta's "privacy-protected" framing, the feature involves sending photo data to Meta's servers for processing. Local-only processing would not require the "cloud" in "cloud processing."
  • Consent creep: Opt-in features have a pattern of expanding over time. A feature that starts as opt-in can become default, and a feature that starts narrow can broaden as users become accustomed to it.
  • Biometric exceptions: Meta excluded Illinois and Texas from the cloud processing rollout, strongly suggesting the feature involves biometric data processing that would trigger liability under BIPA and Texas's biometric privacy law. If the feature did not analyze facial geometry or other biometric identifiers, there would be no reason to exclude these states.

Why Illinois and Texas Were Excluded

Meta did not offer cloud processing to users in Illinois or Texas. Illinois has BIPA, which requires written consent before collecting biometric identifiers and imposes statutory damages of $1,000 to $5,000 per violation. Texas has CUBI, which prohibits capturing biometric identifiers for commercial purposes without consent. The fact that Meta carved these states out is a tacit admission that cloud processing involves biometric data analysis — and that Meta is unwilling to obtain the consent these laws require.

The Tagging Problem: Your Face in Someone Else's Photo

Even if you have locked down your own privacy settings, set your profiles to private, and never posted a public photo in your life, your likeness can still enter Meta's AI training pipeline through other people's posts.

Here is how. Your friend posts a public photo of your birthday dinner on Facebook. They tag you in the photo. That photo — including your face, your name (through the tag), the location, the date, and everything else visible — is now public content that Meta can use for AI training. You did not post it. You may not have known about it. Your privacy settings are irrelevant because it is not your post.

The same applies to workplace photos posted by your employer's public page, event photos posted by public groups, news articles that include your image, and any other public content where you appear. Meta's AI training ingests public content from across its platforms without regard to whether every individual appearing in that content has consented.

This is not a theoretical concern. Meta's AI image generation tools have been documented producing images that closely resemble real people — people whose photos were part of the training data. What You Can Actually Do

You cannot opt out of Meta's AI training in the US. But you can significantly reduce your exposure by limiting how much public content Meta has access to.

  1. Set your Facebook profile to private. Go to Settings → Privacy → set "Who can see your future posts?" to "Friends." Then use the "Limit Past Posts" tool to change all previous public posts to friends-only. This does not retroactively remove data already ingested for AI training, but it prevents future posts from entering the pipeline.
  2. Switch your Instagram account to private. Go to Settings → Account Privacy → toggle "Private Account" on. Private Instagram accounts' posts are not included in Meta's AI training data. Note that any posts made while your account was public may already have been collected.
  3. Review and remove tags. Go through photos you are tagged in and remove tags from public posts. On Facebook: go to your Activity Log → "Photos and Videos" → "Photos and Videos You're Tagged In." On Instagram: go to your profile → tagged photos → review and remove tags on public posts.
  4. Turn off tag suggestions. On Facebook: Settings → Face Recognition → turn off. This prevents Meta from suggesting tags of your face to other users, which reduces the number of tagged photos of you in the system.
  5. Do not enable cloud processing. If prompted to enable Meta AI's cloud processing feature, decline. Once enabled, Meta AI can access photos from your camera roll that you never chose to share publicly.
  6. Audit your public interactions. Comments you leave on public pages, groups, and posts are public content regardless of your profile's privacy settings. Be deliberate about where you comment. Every public comment is potential AI training data.
  7. Download and review your data. Use Meta's "Download Your Information" tool (Settings → Your Facebook Information → Download Your Information) to see the full scope of data Meta holds. This will not stop AI training, but understanding the volume of data — often spanning a decade or more of posts, photos, messages, and activity — puts the issue in perspective.

The Data Broker Connection

Meta's AI training does not exist in isolation. It is part of a larger ecosystem of data collection that includes data brokers — and the two amplify each other.

Data brokers like Spokeo, BeenVerified, and PeopleFinders routinely scrape public social media profiles. Your Facebook profile photo, listed employer, education history, and city are pulled into broker databases and combined with information from public records, property filings, court records, and other sources. The Regulatory Outlook

The regulatory gap between the EU and US on AI training data is likely to persist in the near term. The American Privacy Rights Act (APRA), which would have been the first comprehensive federal privacy law, stalled in Congress in 2024. No comparable bill has gained significant traction since.

At the state level, several comprehensive privacy laws classify personal data used for AI training as a form of processing that requires transparency and, in some cases, consent. The California CPPA has been examining AI training practices as part of its rulemaking authority under the CCPA, and draft rules published in late 2025 included provisions that could apply to Meta's use of public user content. However, those rules have not been finalized.

The FTC has expressed interest in AI training data practices. In 2024, the FTC issued orders to several AI companies requiring them to disclose their training data sources and practices. Whether the FTC has the authority to prohibit companies from using public user content for AI training — or to require an opt-out mechanism — remains legally untested.

For now, the most effective protection for US users is practical rather than legal: minimize the amount of public content available for collection, and actively manage personal data that is already in broker databases.

The fact that X and LinkedIn offer opt-out toggles while Meta does not is notable. It suggests that offering an opt-out is a business decision, not a technical impossibility.
